Anyone else use this combination?

Wife bought me the new lens for upcoming africa tirip.

My camera keeps locking up to the point that I sometimes have to pull the battery to reset it. Other lenses are fine.

Tamron wants me to send it back, camera store says it's because I have an older camera. I don't think that's true though because lens came out while D70s were still in production. There are no new software updates available for the camera.

Google only pulls up debate over superzoom lens clarity.

Has anyone else had this problem?

On a side note, when the lens works, the pictures are clear.

If it helps at all, I have the Canon mount version, and occasionally I get a "lens communication" error. If it happens, I normally switch off the camera, take the lens off and mount it again, and switch the camera on again clears it. I suspect the electrical contacts may be marginal at times, but overall it happens rarely for me. I don't get that with any other lens.
